Subscription terms

Last updated: 2 November 2026

These terms cover the leads service Before Tender provides to businesses for a monthly fee. They're written plainly; if anything isn't clear, ask us and we'll explain.

1. Who we are

Before Tender Ltd, registered in England and Wales, company number 17522493. Registered office: 67 Cambrai Avenue, Chichester, England, PO19 7UU. Email joe@beforetender.uk, phone 07915 911422.

"We" and "us" means Before Tender Ltd. "You" means the business that subscribes.

2. Our agreement

  1. These terms, together with your plan (section 3) and anything else we've agreed with you in writing, make up our whole agreement. If something agreed in writing for your plan differs from these terms, what was agreed for your plan wins.
  2. The agreement starts when you pay for your first month (for example, through the payment link we send you) or when you accept your first invoice.
  3. The service is for businesses only. By subscribing you confirm you're acting for a business and that you're authorised to agree to these terms for it.

3. What you get: your plan

  1. Your plan is what we agreed with you before you subscribed: the kinds of work you want leads for, the area they cover (for example, a list of council districts or counties) and the monthly price. It's shown on the payment page and on every invoice, and we'll confirm it by email.
  2. While your subscription is active we'll send you leads that fit your plan: projects we find in papers that councils, churches, schools, charities and other bodies publish, and other public sources. You'll usually get a weekly email, a private web page listing every current lead for you, and short alerts when timing matters.
  3. Leads from new kinds of source we start reading within your area and work are included at no extra cost. Adding areas or kinds of work is an upgrade we'll agree with you, with a new price.
  4. Your plan is non-exclusive: we may send the same leads to other businesses, including your competitors, unless we've agreed exclusivity with you in writing.
  5. How many leads you get depends on what's published. Any figures we give you (for example, leads a month in your area) are estimates from what we've found so far, not a promise, unless we've agreed a guarantee in writing.

4. What leads are, and what they aren't

  1. A lead is information: what a body has published about a project it's planning, where the project stands, and who to contact, as best we can tell from public sources.
  2. We read and check leads before sending them, and mark early hints and anything we haven't confirmed. But papers can be out of date or wrong, and plans change. We can't guarantee that a lead is complete or accurate, that a project will go ahead, or that you'll be invited to quote or win the work.
  3. It's your decision whether and how to follow up a lead. Check anything important with the buyer before relying on it.

5. Price and payment

  1. The price for your plan is the monthly figure we agreed, plus VAT at the applicable rate. While we aren't registered for VAT, no VAT is charged. If we register, we'll add VAT at the standard rate from then on and tell you at least 30 days beforehand.
  2. Unless we've agreed otherwise, you pay monthly in advance by card or Direct Debit through our payment provider, Stripe, from the day you subscribe. If we've agreed monthly invoices, each one is due within 14 days.
  3. There's no free month: the free sample of leads we send before you subscribe is the trial.
  4. If a payment fails, we'll let you know and our payment provider will try again. If it still hasn't been paid 14 days after it was due, we may pause your leads until it is.
  5. We may change the price of your plan by telling you at least 30 days before the change takes effect. If you don't want to continue at the new price, you can cancel before it starts.

6. Cancelling

  1. You can cancel at any time by emailing us or replying to any of our emails. Your subscription then runs to the end of the month you've already paid for, and isn't renewed. We don't refund part months.
  2. If your plan has a fixed term agreed in writing, the cancellation terms in that agreement apply instead.
  3. We may end your subscription by giving you 30 days' notice, and we'll refund anything you've paid for the period after it ends.
  4. Either of us may end the agreement straight away if the other seriously breaks these terms and doesn't put it right within 14 days of being asked to, or becomes insolvent.
  5. When your subscription ends, we stop sending leads and your private list page is switched off.

7. Using the leads

  1. The leads, emails and list pages we send are for use within your own business, by your own staff.
  2. Please don't resell, publish or pass them on to anyone outside your business, and don't share your private list page's address. If we find leads are being shared, we may pause or end your subscription.
  3. Our emails, list pages and the way we put leads together belong to us. While your subscription is active (and afterwards, for leads you've already received) you may use them as these terms allow. The facts in a lead come from public sources and aren't ours.

8. Contacting people named in a lead

  1. A lead may include a contact at the buying body, usually the contact details the body itself publishes. When you use them, you're responsible for how you do so: contact people about the project in the lead, in a professional way, and follow the law on data protection and marketing (including the UK GDPR, the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations).
  2. Don't say or suggest that you're contacting someone on our behalf, or that the buyer asked us to put you in touch, unless we've actually introduced you.
  3. For personal data in a lead, you're a separate controller from us once you've received it. Our privacy notice (beforetender.co.uk/privacy.html) explains what we do with personal data, including yours.

9. Confidentiality

Each of us will keep confidential anything the other shares privately in connection with the service (for example, your pricing, your plans, or how we find leads), and only use it for the service. This doesn't cover anything that's public, that the other already knew, or that the law requires to be disclosed.

10. Our responsibility to you

  1. We'll provide the service with reasonable care and skill.
  2. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited.
  3. Otherwise:
    • we're not liable for loss of profit, revenue, contracts, business or goodwill, or for any indirect or consequential loss, including work you don't win or a project that doesn't go ahead;
    • our total liability to you under or in connection with this agreement is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.
  4. We're not responsible for delays or failures caused by things outside our reasonable control, such as a body's website being unavailable or a failure of a service we rely on. Where that happens for more than a month, either of us may end the subscription, and we'll refund anything paid for the period after it ends.

11. Changes to these terms

We may update these terms from time to time, for example when the law changes or we add to the service. We'll tell you by email at least 30 days before a change that matters to you takes effect. If you don't want to continue under the new terms, you can cancel before they start.

12. Complaints

If you're unhappy with anything, please tell us at joe@beforetender.uk. We'll reply within five working days and try to put it right.

13. Notices

We'll contact you by email at the address you gave us when you subscribed (or one you've told us about since). You can contact us at joe@beforetender.uk. An email counts as received on the next working day after it's sent.

14. General

  1. We may transfer this agreement to another business, including a buyer of all or part of our business, and will tell you if we do. You may transfer it only with our written agreement.
  2. Nobody other than you and us has any right to enforce these terms.
  3. If a court finds part of these terms can't be enforced, the rest still applies.
  4. If we don't enforce something straight away, we can still enforce it later.
  5. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
